1. Definitions
- Platform: Societal’s event discovery, ticketing, and management services accessible via [website/app].
- Organizer: Any entity/person using Societal to create, promote, or manage events.
- Consumer: Users purchasing tickets, registering for events, or accessing event content.
- Services: Features including event creation, payment processing, analytics, marketing tools, and APIs.
- Your Content: Text, images, logos, videos, or data uploaded by Users.
- Societal Fees: 5–15% commission per ticket sale (variable based on event type, ticket volume, or promotional agreements).
- Event Proceeds: Gross ticket sales minus Societal Fees, payment gateway charges, and taxes.
2. Acceptance of Terms
By using Societal, you agree to:
- Comply with these Terms, Privacy Policy, and all applicable Pakistani laws (e.g., PECA 2016, Sales Tax Act 1990).
- Warrant that you are 18+ or have legal guardian consent.
- Acknowledge that violating these Terms may result in account suspension, legal action, or liability.
3. Societal’s Role
3.1 Platform Services
Societal provides tools for Organizers to host events and Consumers to discover/purchase tickets.
We are not the event host nor liable for:
- Event quality, safety, or accuracy.
- Organizer/Consumer disputes (e.g., refunds, cancellations).
- Third-party actions (e.g., payment gateway failures, venue issues).
3.2 Modifications
Societal reserves the right to:
- Edit, suspend, or remove events/content violating laws, third-party rights, or community guidelines.
- Adjust fees, features, or policies with 30 days’ notice.
4. Organizer Obligations
4.1 Event Management
- Accuracy: Ensure event details (dates, pricing, venue) are truthful and comply with local laws (e.g., Punjab Entertainment Act).
- Licensing: Obtain permits (e.g., NOC from local authorities, security clearance for large events).
- Tax Compliance: Remit 17% sales tax and file returns via FBR. Provide tax invoices to Consumers.
4.2 Financial Terms
- Fees: 5–15% commission + payment gateway charges (e.g., 2.5% for PayFast).
- Payouts: Processed within 7–14 business days post-event, subject to fraud checks (e.g., chargebacks, fake tickets).
- Minimum Threshold: PKR 10,000 (adjustable for recurring Organizers).
4.3 Refunds & Cancellations
- Organizers must publish clear refund policies.
- Societal may or may not issue refunds if events are canceled or materially altered (e.g., date/venue changes).
4.4 Liability
Organizers indemnify Societal against claims arising from:
- Attendee injuries, property damage, or fraud.
- Violations of intellectual property, privacy, or consumer rights.
5. Consumer Obligations
5.1 Ticket Purchases
- Tickets are non-transferable without Organizer/Societal approval.
- Resale for profit ("scalping") is prohibited; resold tickets may be invalidated.
5.2 Data Privacy
- Location Data: Used to recommend nearby events. (Disable via device settings).
- Sharing: Contact details shared with Organizers for event logistics (e.g., attendee lists).
5.3 Prohibited Conduct
- Fraudulent purchases, harassment, or uploading illegal/pirated content.
6. Intellectual Property
6.1 Ownership
- Organizers/Users retain ownership of Your Content but grant Societal a global, royalty-free license to use, modify, and display it for platform operations and marketing.
6.2 Trademarks
- Societal’s logos/trademarks are owned exclusively by Societal.
- Unauthorized use (e.g., counterfeit tickets) will result in legal action.
6.3 Copyright Complaints
- Report infringing content via mysocietal.live.
- Societal will remove violating material per Pakistani Copyright Ordinance 1962.
7. Payments & Disputes
7.1 Payment Processing
- Third-party gateways (e.g., JazzCash, EasyPaisa) handle transactions.
- Societal is not liable for delays/errors.
- Chargebacks: Organizers bear costs for disputed transactions + PKR 500 processing fee.
7.2 Dispute Resolution
- Mediation: Parties agree to resolve disputes via [Pakistani mediation body] before litigation.
- Governing Law: Pakistani law; disputes adjudicated in courts of [Karachi/Islamabad/Lahore].
8. Termination
Societal may suspend accounts for:
- Fraud, illegal activity, or repeated policy violations.
- Non-payment of fees or chargebacks.
Organizers must fulfill obligations for active ticket sales post-termination.
9. Data Protection
- Complies with Pakistan’s Draft Personal Data Protection Bill (when enacted).
- Data stored securely on local servers.
- No sale of Consumer data to third parties.
- Right to access/correct personal information via account settings.
10. Force Majeure
Societal is not liable for failures due to:
- Natural disasters (e.g., floods, earthquakes).
- Government actions (e.g., internet shutdowns, curfews).
- Pandemics, strikes, or terrorism.
11. Amendments
- Societal may update Terms with 30 days’ notice (email/platform notification).
- Continued use implies acceptance.
